In these Terms, "TrustedCaptcha", "we", "us", and "our" refer to AESHA Technology Services Limited, a private limited company registered in Seychelles under company registration number 210193, with registered address at 1032 Office House of Francis Ilu de Port, Mahe, 00000, Seychelles. "Service" refers to the TrustedCaptcha CAPTCHA verification platform accessible at trustedcaptcha.com and challenges.trustedcaptcha.com. "Customer", "you", and "your" refer to the entity or individual using the Service.
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
TrustedCaptcha provides a CAPTCHA verification API. We process verification challenges issued through your sites and return success/failure decisions to your servers. The Service is provided "as is" without warranty of fitness for any particular purpose.
You may not: (a) use the Service to facilitate any illegal activity; (b) attempt to circumvent rate limits, authentication mechanisms, or security controls; (c) reverse-engineer the Service except to the extent permitted by mandatory applicable law; (d) resell or sublicense the Service without a separate agreement; (e) use the Service to protect content that is itself unlawful (e.g., CSAM, terrorist content, content prohibited by EU law).
The Free Developer plan provides 1,000 verifications per calendar day per account, all features included. We may modify the free tier limits with 30 days notice. We may rate-limit or temporarily disable accounts that consistently exceed the free tier without upgrading.
Pro plans are billed monthly (€25) or annually (€200) via Stripe Payments Europe Ltd (Ireland), with a 7-day free trial. Subscriptions auto-renew until cancelled. Cancellations take effect at the end of the current billing period. EU VAT is added where applicable based on your billing country.
For Pro customers we target 99.9% monthly uptime. If we fall below this in a given calendar month, you may request a service credit equivalent to that month's subscription fee (capped at one month's fee). Credit requests must be submitted within 30 days of the end of the affected month.
For personal data processed in connection with the Service, we act as a data processor; you are the controller. Article 28 GDPR data processing terms are set out in our Data Processing Agreement, which is incorporated by reference into these Terms for Pro customers and is available on request for Free tier customers.
Each party will protect the other's confidential information using the same degree of care it uses for its own confidential information of like kind, but no less than reasonable care.
The Service, including the widget code, dashboard interface, brand, and documentation, is the property of TrustedCaptcha or its licensors. The widget loader (api.js) is licensed to you under MIT for embedding on sites you operate, subject to these Terms.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the amounts paid by you to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, or for loss of profits, data, or business opportunity. Nothing in these Terms limits liability for fraud, willful misconduct, or anything that cannot be limited by law.
You will defend, indemnify, and hold us harmless from third-party claims arising out of your breach of Section 4 (Acceptable Use).
You may terminate at any time by deleting your account. We may suspend or terminate your account for material breach of these Terms with notice (or without notice for Section 4 violations causing imminent harm).
These Terms are governed by the laws of the Seychelles. Disputes are subject to the exclusive jurisdiction of the courts of the Seychelles, except that you may bring proceedings in your country of residence as required by mandatory consumer protection law.
We may update these Terms; material changes will be notified by email at least 30 days in advance.
